Legal Separation

Legal separation provides separation of marital community but the parties remain married.

Sometimes a party wishes to legally separate from their spouse but not divorce them. Legal separations are not a prerequisite to a divorce. Rather, it provides separation of marital community but the parties remain married.

Whether the legal separation is desired for religious or other personal reasons, a legal separation is similar to a divorce in how it addresses the division of property, maintenance, parenting plan and child support.

  • A legal separation provides protection against the accumulation of additional community debt.

  • It also stops the accumulation of community assets.

A legal separation can be converted by either party into a dissolution after six months.
